Our guarantee removes the uncertainty that the Federal Stimulus Incentive Program has created about whether the Electronic Health Record (EHR) that your practice is selecting will meet the “meaningful use” and “certification” requirements under the HITECH Act. This is important because the government is offering a significant amount of stimulus money to physicians over the next few years for “meaningful use” of an EHR. As your business partner, we want your practice to be in a position to maximize that benefit.
We are so certain that our product (Greenway Medical’s PrimeSuite) can make your practice eligible to get these Federal Stimulus dollars that we’re guaranteeing that as long as you meet the required billing thresholds for either Medicare or Medicaid, and if you use our product in a "meaningful way" you will be eligible for the Federal Stimulus incentives.
How can we guarantee you’ll be qualified for HITECH Act incentive payments? Because our software partner, Greenway Medical is a leader on Health IT mandates from Washington, D.C, since it chairs several of the industry policy committees. Additionally, Greenway Medical has not only already made a substantial investment into complying with all of the federal requirements, but was one of the first EHR firms to apply to CCHIT, the federally recognized certifying body for EHR software for stimulus reimbursement, to move from its CCHIT 2008 certification to the important CCHIT 2011 certification. Finally, our solution generally enables seamless communication across the healthcare community, which is important if the true vision of EHR is to be realized.
Terms and Conditions: PrimeSuite 2008 is a fully CCHIT Certified® 08 ambulatory EHR, according to criteria set forth by the Certification Commission for Healthcare Information Technology's (CCHIT®), including certification for cardiovascular medicine and child health. Greenway will renew PrimeSuite's CCHIT certification so long as CCHIT is the federally recognized certification body. During the term of the Client's Agreement, so long as Client is a party to a current Support Services Agreement, the PrimeSuite Software shall comply with all applicable certification criteria to be promulgated by the Office of the National Coordinator for Health Information Technology for purposes of determining whether an eligible professional is a meaningful user of certified EHR technology (as those terms are defined in Title XIII of the American Reinvestment and Recovery Act (“ARRA”), P.L. 111-5) and thus is eligible for Medicare and Medicaid incentive payments for use of health information technology as established under ARRA. To the extent that Greenway must make modifications to the PrimeSuite Software to meet such certification criteria, such modifications shall be covered under Greenway's Support Services Agreement at no additional charge, and Client shall be notified of such modifications.
II. Quality of Service
There are some horror stories in the medical community about failed EHR implementations, where practices have spent an enormous amount of money will little results. However, the research shows that most of these stories could have been prevented through quality training and/or improved customer service. R&D MedTech never wants any of our clients to be one of these negative case studies, so we have created our quality service guarantee program. This Program guarantees Top quality training and support by certified trainers, and a fully functional solution with swift and professional implementation.
Terms & Conditions
“We will train Your Practice to productively use the Software” means that the Service hours for training and implementation set forth in the contract will be sufficient to train all users designated at the time of the contract to use the software. Additional training may be augmented by the available free on-line webinars that we make available for our customers. We also use a train-the-trainer approach so as to enable designated staff to train new employees on how to use the Software in a production environment, as stated in the User Materials. If we fail to make available such free training sessions during the first three (3) years from the Effective Date, then upon your written request and return of all Hardware and Software purchased from R&D MedTech under the Agreement, the Agreement will be deemed terminated and Your refund will be promptly processed for the license and hardware fees paid. (Specifically excluded from the above are additional Service hours required as a result of (a) Your requiring work which has already been performed and approved by You to be done again or done differently; (b) on-going adaptations to templates and clinical documents after the Software is already in use; (c) training or re-training as a result of new customer staff or customer personnel turnover; (d) end-user training and (e) additional location rollouts.)
“We will provide Your Practice top quality support” means that provided You are current in your payment for Software Maintenance Services, we will provide You with high quality support services with guaranteed response times, and should You notify our support department that the Software is inoperable then we will use our best efforts to: (i) respond to Your call within two (2) hours and (ii) remedy such matter, to the extent the trouble lies within the Software, within forty-eight business hours. If we fail to respond to the initial incident of such matter within two hours (“Failure”) and such Failure(s) occurs more than two times within a calendar quarter, then we will refund to You the full Software Maintenance Services fee paid by You during the calendar quarter.
